Del Mar Thoroughbred Club, the operator of this website (“we”, “us”, “our” or “DMTC”), provides this Privacy Policy to disclose how we collect and use information that you provide as well as your rights to access, update and delete your data. We refer to our employees, directors, offices, contractors, equity owners, parents, subsidiaries and agents as our “affiliates” in this Privacy Policy.

DMTC collects and stores any information that you enter on our websites or give us in any other way. Examples include:

2. INFORMATION FROM SOCIAL NETWORKING SITES

If you use the Service on a mobile device or through a mobile application or sign up for SMS notifications or push notifications (where available), we may receive information about your equipment, including, without limitation, your mobile device identifier and/or IP address, the name you have associated with your device, device type, telephone number, country and geolocation. We use various technologies to determine IP address, GPS, and other sensors that may, for example, provide us with information on nearby devices, Wi-Fi access points and cell towers. Most mobile devices allow you to adjust location-based services and other information provided by your device.

DMTC, its affiliates, service providers and/or advertisers may use various automatic data collection technologies to collect certain information about your use of our Service, including, without limitation, “cookies” (text files placed by a Website’s server on a visitor computer hard drive) and other similar technologies, such as “flash cookies” (local stored objects not managed by the same browser settings as browser cookies), “web beacons” (small electronic files also referred to as clear gifs, pixel tags, and single-pixel gifs that permit us to count users who have visited a page or opened an e-mail), and other identifiers. 6. PAYMENT TRANSACTION INFORMATION

We collect information related to your payment transactions through the Service, including the payment instrument used, date and time, payment amount, payment instrument expiration date and billing postcode, IBAN information, your address and other related transaction details. This information is necessary for the adequate performance of the contract between you and DMTC.

7. AGGREGATE INFORMATION

We may also use cookies and similar automatic data collection technologies discussed above to collect information that is not personally identifiable, such as information about your online activities across third-party websites or other online services, advertising, demographic and other analytic data.

In the event that our assets are sold or transferred to another party, or another transaction occurs in which your personally identifiable information is one of the business assets transferred, all personally identifiable information that has been collected and saved may be one of the business assets we transfer. 7. THIRD-PARTY AD SERVING AND AUDIENCE AND TRAFFIC MEASUREMENT SERVICES(SALE OR SHARING OF DATA FOR TARGETED ADVERTISING)

We may use a third-party network advertiser to serve the advertisements on the Service or may use a traffic measurement service to analyze the traffic on the Service, which is considered “selling” under certain privacy laws or “sharing” for cross-context behavioral advertising. Network advertisers are third parties that display advertisements based on your visits to this Service and other websites you have visited. 1. Right to Know and Data Portability:  You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past twelve (12) months (the "right to know"). 

2. Right to Delete: You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions (the "right to delete"). Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. 

We will delete or deidentify personal information not subject to an exception from our records and will direct our service providers to take similar action.

3. Right to Correct: You may have the right to request that we correct any inaccurate personal information we may hold about you.  We will use commercially reasonable efforts to correct inaccurate personal information, taking into account the nature of the personal information and the purpose for our processing.

We may need to verify your identity before processing your request.  Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information.  You may also make a request to know or delete on behalf of your minor child by the same methods described above. To designate an authorized agent to make a request on your behalf, please provide us with a power of attorney or other legally binding document signed by you and identifying your agent.  We may also verify the identity of your designated agent.   In order to verify your identity, we may require you to provide your name, email address, and phone number. 

You do not need to create an account with us to submit a request to know or delete. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account. We will only use personal information provided in the request to verify the requestor's identity or authority to make it. 

5. Personal Information Sales Opt-Out and Opt-In Rights: If you are age 16 or older, you have the right to direct us to not sell your personal information at any time (the "right to opt-out"). We do not sell the personal information of consumers we actually know are less than 16 years old. Consumers who opt-in to personal information sales may opt-out of future sales at any time. To exercise the right to opt-out, you (or your authorized representative) may submit a request to us using the methods described above.  Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sales at any time by emailing us at info@dmtc.com. You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request. 

6. Sensitive Personal Information: Certain information we collect and use to provide you our products or services may be considered “sensitive personal information.” These include your username and password to your account. We do not use or disclose such sensitive personal information to “infer” characteristics or for any purpose other than that which is necessary to provide our products or services.

7. Non-Discrimination: We will not discriminate against you for exercising any of your rights. 

8. Rectification of Inaccurate or Incomplete Information: You have the right to ask us to correct inaccurate or incomplete personal information concerning you.

Data Retention and Erasure:  We generally retain your personal information for only as long as is necessary for the performance of the contract between you and us and to comply with our legal obligations. If you no longer want us to use your information to provide the Service to you, you can request that we erase your personal information and close any accounts created through the Service by following the instructions in the Contact Us section below. Please note that if you request the erasure of your personal information: 

  • We may retain some of your personal information as necessary for our legitimate business interests, such as performing contracts, fraud detection, and prevention and enhancing safety.
  • We may retain and use your personal information to the extent necessary to comply with our legal obligations, such as for tax, legal reporting, and auditing obligations.
  • Because we maintain the Service to protect from accidental or malicious loss and destruction, residual copies of your personal information may not be removed from our backup systems for a limited period of time.

11. Objection to Processing: In some cases, applicable law may entitle you to require DMTC not to process your personal information for certain specific purposes (including profiling). If you object to such processing, DMTC will no longer process your personal information for these purposes unless we can demonstrate compelling legitimate grounds for such processing or such processing is required for the establishment, exercise, or defense of legal claims. Where your personal information is processed for direct marketing purposes, you may, at any time ask DMTC to cease processing your data for these direct marketing purposes by sending a communication to DMTC at info@dmtc.com.

SECURITY

We are continuously implementing and updating our administrative, technical and physical security measures to help protect your information against unauthorized access, loss, destruction, or alteration. We incorporate reasonable safeguards to protect the security, integrity, completeness, accuracy and privacy of the personal information that we may collect, including firewalls and data encryption, and information access controls. The safety of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Service, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

The Service, including mobile applications and pages we make available through social networking sites such as Facebook, may have features that allow you to post information that can be viewed by other visitors, such as commenting, chat rooms, forums and message boards. You are not required to provide any personal information when using these features but you may choose to do so. If you post personal information online, it will be publicly available and you may receive unsolicited messages from other parties. In addition, when you post a comment to a mobile application, the user name with which you registered for the Service and your current location may be made publicly available on the Service and through the mobile application. HOW WE SHARE INFORMATION WE COLLECT

As described below, we may share your information with others for various purposes:

1. AGENTS

We employ other businesses and individuals to perform functions and services on our behalf. Examples may include fulfilling orders, site analysis, analyzing data, providing marketing assistance, processing credit card payments and providing customer service. They may have access to personally identifiable information needed to perform their functions.

2. AGGREGATE INFORMATION

3. THIRD PARTY OFFERS

We never sell your information as that term is traditionally defined, but we may occasionally send communications from valued DMTC partners. These offers will be sent only when we believe that a communication will be beneficial to DMTC enthusiasts. If you do not want us to use your information in this way, you can find information on how to update your consent preferences in the Your Rights Section of this Privacy Policy. Please be aware that if you elect to provide your personally identifiable information in response to third party marketing offers or otherwise, all information you disclose will be subject to the privacy policy and practices of such third parties, and you should review these policies before providing your information.

4. AFFILIATES

We may share your information (including without limitation personally identifiable information) with our affiliates.

5. TRANSFERS

In the event that our assets are sold or transferred to another party, or another transaction occurs in which your personally identifiable information is one of the business assets transferred, all personally identifiable information that has been collected and saved may be one of the business assets we transfer. In connection with negotiating a transfer, a potential buyer may have access to personally identifiable information of our customers or followers. We will not sell only personally identifiable assets of our customer or followers – a sale of such information would only occur in connection with the sale of other assets. 7. THIRD-PARTY AD SERVING AND AUDIENCE AND TRAFFIC MEASUREMENT SERVICES(SALE OR SHARING OF DATA FOR TARGETED ADVERTISING)

We may use a third-party network advertiser to serve the advertisements on the Service or may use a traffic measurement service to analyze the traffic on the Service, which is considered “selling” under certain privacy laws or “sharing” for cross-context behavioral advertising, including the California Consumer Privacy Act. Third-party ad serving enables us to target advertisements to you for products or websites in which you might have an interest. Other than as described above, your personal information will not be used or processed without your express consent.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

YOUR RIGHTS AND CHOICES

You may have certain rights as a consumer regarding your personal information. This section describes your rights and explains how to exercise those rights.

1. Right to Know and Data Portability: You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past twelve (12) months (the "right to know").

2. Right to Delete: You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions (the "right to delete"). Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies.

We will delete or deidentify personal information not subject to an exception from our records and will direct our service providers to take similar action.

3. Right to Correct: You may have the right to request that we correct any inaccurate personal information we may hold about you. We will use commercially reasonable efforts to correct inaccurate personal information, taking into account the nature of the personal information and the purpose for our processing.

4. Exercising Your Rights: To exercise your right to know, delete or correct described above, please submit a request by either:

We may need to verify your identity before processing your request. Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information. You may also make a request to know or delete on behalf of your minor child by the same methods described above. To designate an authorized agent to make a request on your behalf, please provide us with a power of attorney or other legally binding document signed by you and identifying your agent. We may also verify the identity of your designated agent. In order to verify your identity, we may require you to provide your name, email address, and phone number.

You do not need to create an account with us to submit a request to know or delete. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account. We will only use personal information provided in the request to verify the requestor's identity or authority to make it.

5. Personal Information Sales Opt-Out and Opt-In Rights: If you are age 16 or older, you have the right to direct us to not sell your personal information at any time (the "right to opt-out"). We do not sell the personal information of consumers we actually know are less than 16 years old. Consumers who opt-in to personal information sales may opt-out of future sales at any time. To exercise the right to opt-out, you (or your authorized representative) may submit a request to us by  using the methods described above. Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sales at any time by emailing us at info@dmtc.com. You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.

6. Sensitive Personal Information: Certain information we collect and use to provide you our products or services may be considered “sensitive personal information.” These include your username and password to your account. We do not use or disclose such sensitive personal information to “infer” characteristics or for any purpose other than that which is necessary to provide our products or services.

7. Non-Discrimination: We will not discriminate against you for exercising any of your rights.

OTHER CALIFORNIA PRIVACY RIGHTS

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
