  1. Contest Description: The Opening Day Hats Contest (the “Contest”) is a non-wagering contest that will take place at the Del Mar Thoroughbred Club (DMTC) on Opening Day, Saturday, July 20, 2024.

    The contest provides eligible entrants with the opportunity to show off their best hat and attire on track on Opening Day. Eligible submissions will be evaluated by representatives of Del Mar Thoroughbred Club (DMTC) that will select the Grand Prize winner as described herein. 

    By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of the Del Mar Thoroughbred Club, which shall be final and binding in all respects. 

  2. Eligibility: Contest is open only to legal United States residents who are eighteen (18) years of age or older and who have not been convicted of a felony or any crime of moral turpitude or have been prohibited/excluded from gambling in any state or jurisdiction. Proof of age and identity is required to claim prizes.

    Employees, officers and directors of Del Mar Thoroughbred Club, their respective parents, subsidiaries, affiliates, advertising, promotion and other agencies (collectively, the “Contest Entities”), and their immediate family members and/or those living in the same household of each are not eligible to participate. Void where prohibited by law. All federal, state, and local laws and regulations apply. 

    Hats should be of original design - either purchased, borrowed, or bespoke. Entries should be of reasonable size and quality with appropriate content.

  3. How to Enter: To enter contest, contestants must register in the Plaza de Mexico between 11:30 a.m. and 3:00 p.m. 

    One entry per contestant, contestant may enter in one of the following four categories:

    • Most Glamorous
    • Best Flowers
    • Best Fascinator
    • Best Racing Theme / All Others
     

    Each entry must meet the following “Entry Requirements” (any entry that, in DMTC’s sole and absolute discretion, violates the following criteria will be disqualified):

    • Submissions must NOT contain any material that infringes or violates any right of a third party including copyright, patent, trademark, trade secret or other proprietary rights, other than those belonging to DMTC.
    • Submissions must NOT contain any derogatory references to any of the Contest Entities.
     

    Note: DMTC reserves the right, in its sole discretion, to disqualify any entry in the Contest if it views the submission as potentially infringing or otherwise a potential violation of a third party’s rights or if it deems the submission to be inappropriate, derogatory, or otherwise objectionable.

    Entrants understand that they are sharing their submission at their sole risk. DMTC is not responsible for any claims arising from the submission, specifically including, but not limited to, claims for intellectual property infringement and privacy rights violations. No purchase neccessary. To participate without a ticket to Opening Day, submit one picture with your preferred category to contest@dmtc.com between 8:00 a.m. and 11:00 a.m. Pacific Time on Saturday, July 20. 

  4. Judging, Winner Selection and Notification:

    Representatives of DMTC will judge all approved entries based on creativity and originality, total ensemble is considered. The judging of entries will be conducted under the supervision of DMTC whose decisions are final and binding in all respects relating to selection. Representatives of DMTC will select the top finishers in each category. A panel of celebrity judges will then select the Grand Prize Winner from the first place winners of each category. Winners will be contacted directly after the 5th race. First place winners in each category will report to the Winners' Circle for the Grand Prize presentation after the 6th race. Prize winners will be posted on DMTC's website. Select submissions may additionally be showcased on DMTC’s website, social media channels or elsewhere without territorial time or other use restrictions. Being selected as a featured submission has no bearing on the ultimate outcome of the Contest. Eligibility for prizes is limited to the persons who sign the entry form and completion of a W-9 form. Judges' decisions are final.

  5. GRANT OF RIGHTS: Each entrant into the Contest hereby irrevocably grants to Sponsor, its designees, affiliates, successors and assigns, the non-exclusive, irrevocable, fully paid, universal license to use, copy, sublicense, transmit, distribute, publicly perform, publish, delete or display the submission in any media now known or hereafter devised including, but not limited to all forms of electronic media, print media and all forms of internet and wireless protocol in perpetuity and throughout the universe for advertising, marketing, publicity and promotional purposes in connection with the Contest and other promotions. Sponsor shall have the right, in its sole discretion, to edit, composite, morph, scan, duplicate, or alter the submission for any purpose which Sponsor deems necessary or desirable, and each entrant irrevocably waives any and all so-called moral rights they may have therein.

  6. PUBLICITY RELEASE: By participating in the Contest, in addition to any other grants which may be granted in any other agreement entered into between Sponsor and any entrant in or winner of the Contest, each entrant irrevocably grants the Sponsor and its designees, successors, assigns and licensees, the right to use such entrant’s name, likeness, and biographical information in any and all media for any purpose, including without limitation, advertising and promotional purposes and hereby releases the Contest Entities from any liability with respect thereto.

  7. Prizes:

    • Grand PrizeRancho Valencia one night hotel stay and meal for two. $500 Studio Savvy Salon Gift Basket. 
    • First place in each category: $300 plus $250 Studio Savvy Salon gift basket.
    • Second place in each category: $200
    • Third place in each category: $100
     

    Liability for any and all federal, state, or local taxes is solely the responsibility of prizewinners. An affidavit of eligibility and liability will be required to receive. The prizes are as described and there is no cash alternative.

  8. Liability: All contestants, being of lawful age, hereby release and forever discharge DMTC, affiliated advertising, promotion and other companies, and the employees and their immediate family members and/or those living in the same household of each are not eligible to participate. The contestants acknowledge and agree that any conflict or dispute with respect to the rules of the contest shall be resolved by and at the discretion of DMTC. The contestants further consent, authorize and release DMTC to use and reproduce the winners’ photographs, voice on recorded tape and the name in connection with promotions of any other lawful purpose. Personal information collected in connection with this contest will be used in accordance with DMTC's privacy policy. DMTC reserves the right in its sole discretion to cancel, terminate, modify, suspend or extend the Contest.
