Rick Dutrow Jr. Asking Court to Overturn 10 Year Ban

ALBANY, N.Y. — Kentucky Derby-winning thoroughbred trainer Rick Dutrow Jr. is asking New York's top court to overturn his 10-year ban by the state Racing and Wagering Board, saying it raises substantial civil rights issues.

In asking the Court of Appeals to hear Dutrow's case, attorney Michael Koenig (KAY'-neg) says it should decide whether the appearance of bias by racing board Chairman John Sabini cost the trainer his right to a fair proceeding over drug violations.

They say Sabini had a conflicting role as an officer of the Association of Racing Commissioners International, which advocated revoking his license.

A midlevel New York court upheld the ban.

State lawyers say the midlevel court found no evidence of actual bias, and the top court should reject the case.

A ruling is expected next month.

New York's highest court has declined to hear an appeal by trainer Rick Dutrow in his attempt to halt state officials from revoking his license to work in the state.

In a consolidated show of support, I think EVERY trainer in the USA who has used even a slightly illegal drug on a horse, or used a legal drug outside the perscribed times, should boycott the entire Breeder's Cup card.

Richard Duttrow has rubbed someone in a high position of power? i think a group of trainers have crowbarred him, can you say Lance Armstrong saga facing Richard, no questions he cheated but lets just forget bout it :oops:

Why should we forget about it? Forgetting about it is why drug use is so rampant in this sport. When Dutrow or anyone else takes out a trainer's license, they agree to be governed by the "Trainer Responsibility Rule." That means any drug or rule infractions, the trainer is ultimately responsible. THEY AGREE TO THIS IN WRITING! This is not new. This is how it has been for decades.
This is the first time in years a racing jurisdiction is putting their foot down and enforcing this rule. For the last 30 years the stewards and racing boards have been Sh*t scared of litigation. A trainer walks into a meeting with a high powered lawyer and everything is swept under the rug. Why have rules if you aren't going to enforce them?
Dutrow can claim he didn't know til the cows come home, which everyone knows is crap, but he agreed to be responsible when he took out his license. He didn't have a problem agreeing to the rules he just has a problem following them. He was content going merrily along as long as nobody enforced them. He is a major violator and has been for pretty much his entire career. If a suspension will negatively affect his income may he should have thought about that before he broke the rules. Considering his record, suspending him may just send a message to other violators, "We aren't afraid of you and your lawyers. We will enforce the Rules."
And It's about d*mn time!

then what ever you do dont forget that richard mandellas horses tested positive for a drug 50 times stronger than anything ever found in dutrows horses.
the rule is clear the trainer is responisible but mandella got it thrown out. and everyone acts as if mandella is this hay and oats trainer the same trainer who ran a horse who had been nerved trying to get the horse claimed in arizona the only state in the country where nerved horses are allowed to run. what ever you think about dutrow, his horses get the besat care of any trainer at saratoga/belmont/aqueduct. they absolutely stand out in the post parade and always look the best and best behaved too.

Lemme ax u a question. You've made your disdain for gamblers pretty obvious here.You made a statement before that you quit gambling years ago and you now enjoy your life and your family. Why would you dabble in a HR forum? I'm a bit confused. Congrats on the walking away from gambling. Years ago when my kids were 4+5 I quit stone cold for 10 years.I couldn't be in forums,chats,etc.

I completely agree with you on this! They should have thrown the book at him, but Mandella went in with a high priced lawyer and the CHRB pooped their pants!

I'm not saying Dutrow isn't a good horseman, but he knew he was breaking the rules and figured it was worth it at the time. Now he wants to cry that it's not fair? Sorry Bud, you play, you pay. You broke the rules enough times they could no longer ignore it. Now take it like a man!

100% FACT (re:Mandella). King of the Vet List himself has more 6-figure yearling purchases running for maiden 8's up North than anyone I've ever seen.
