Here in AZ we had the case of the pregnant lady, whose was in the later stages of pregnancy, try a similar approach when she was caught in the HOV lane. She said, by standards, the child she was carrying is considered a person, therefore there were actually two people occupying the vehicle and her actions were legal under the law. The judge interpreted the HOV law and statee that not only must a person be living and breathing but also must occupy a seat other than the driver's seat.
