Dropping off a restricted claiming victory to the bottom for Aguirre, favored HIDDEN PASSION proved well spotted, scoring handily under Talamo. The Elusive Quality filly stalked the walking pace two-deep, moved up to vie then quickly took over around the far turn, edged away into the stretch, clear midstretch, ambled all the way to the wire. Par rating, five claims in, Mathis outshook Sanchez, Bonde, Bevoir and Ellis. FIESTA EXPRESS, bought privately since her last start, lacked early speed then dropped back to last down the backstretch, three-deep into the lane, up late to garner the place. RUNNING FOR JAKOB had speed then stalked the slow pace inside, gained around the far turn, all-out while outrun by the winner leaving that bend, chased that one through the drive, no match, outfinished near the wire for second. PEARLOFTHEORIENT raced midpack inside, came out down the backside, within scope around the far turn, three-wide into the stretch, nothing. KATY’S KITTY should have been declared a non-starter. The Osidy mare turned her head while appearing to be held by the assistant starter as the gates opened to be off well behind the field, moved out of last onto the backside, passed horses inside passing the half-mile pole, came out and understandably started to tire from her extended run as she entered the lane, faded badly. The stewards ruled she caused her own trouble, it certainly appeared that was only partially the case as she was definitely being held when the latch was sprung, coincidentally (or not) if she had been declared a non-starter, the one live Pick Six ticket to her would have gone to the winner, and there wouldn’t have been a carryover, previous trainer Knapp dropped two claims to get her back (and he wouldn’t have gotten her had she been declared a non-starter). WARREN’S CHINA DOLL washed out, set the pace around the first turn and down the backside, outrun by the winner around the far turn, tired badly. MEMO TO KATHY couldn’t have run worse.

And...this B.S. about "causing her own problem" doesn't hold water. What if that mare would have put her leg over the side of the stall and was hanging there when the sent the field off? Would they have declared her a starter? Of course not. That "causing her own problem" excuse is usually for horses that dwelt. Regardless of the reason, the guy was hanging onto the mare when they said "go." Case closed.
Very interestingly, Bob Hess Jr. and Bejarano were involved in a similar situation last year with a mare that just stood in the gate. Can't remember her name. Maybe The Beak should learn how to start the ignition so they break better.
Bottom line, the asst. starter and Brinson are going to say whatever they have to in order to save their own behinds. The culprits here are the Stewards. Period. Forget the B.S. interview on TVG. They should be fined or suspended. Can anyone find out if it was a majority or unanimous vote of the Stewards?

Yes there was a ticket alive to her and the favorite won so they would have cashed - if you look at Claimbox's post after mine it says the same thing plus she got claimed - which would have been voided if she was declared a non-starter.

This is all moot, we are stating an opinion on a rule that has to change.
Even if the Asst Starter put a chain with a 1000 pound lead ball around the horses neck, he still would have been a starter.
Yes, he should have be declared a Non Starter, however, the rules state, if the gate is open, That's it
So, contact the CHRB and change the rule.
There are a hundred things the horse and rider can do to get a bad start and it would be their fault, however if a freaking track official is holding the horse or causing the horse to not get a good break, then it's a non-start, same as if the gate opened early or didn't open at all.
